Delhi HC Issues Orders Mint Newspaper to Take Down Article Against YouTuber Gaurav Taneja
The Delhi HC recently issued order against Mint newspaper to take down an article against YouTuber Gaurav Taneja and his wife Ritu Rathee. The article, penned by Shephali Bhatt and published by Mint on may 8, alleged Taneja and his wife to be abusive of their own children. The article had called out Taneja for sharing a video of his elder daughter’s ears piercing.
“The 10-minute video then goes on to show the daughter howling and writhing in pain while the camera zooms in on her,” the author had written. She had further cited a Mangalore-based child psychologist in the article claiming that the act exhibited “clear cases of child abuse”.
Regarding the same, the Delhi High Court observed, “Piercing the ears of a girl child cannot be termed as child abuse. Allegations of child abuse are serious allegations and cannot be made without due care and verification. It cannot be based on the opinions of the author.”
The court directed the newspaper to take down the article. Further, the court also asked journalist Abhishek Baxi to take down defamatory tweets against Taneja.
Earlier this week, the YouTuber filed complaint that his daughter had received death threat call. Prior to that, he was arrested for holding a birthday meet-up at a Delhi metro station.
The Facts of the Matter
YouTuber, social media influencer, and former AirAsia pilot Gaurav Taneja is again in the news. Recently, the Delhi High Court issued an order against The Mint newspaper to take down an article written by Shephali Bhatt. The article, published on May 8, was allegedly defamatory in nature against Taneja and his wife Ritu Rathee.

Article Asked Brands to Not Support Gaurav Taneja
The Delhi HC was hearing a plea by Taneja and his wife, seeking an order against Mint and its journalist regarding an article titled “Shouldn’t brands stop supporting sordid influencers?”. In the article, the author has called for brands to stop supporting influencers like Taneja, and further alleged him of child abuse.
Allegations Hurled by Journalist in Mint Article
Taking note of the article, Justice Amit Bansal observed that there were no clear evidences to prove allegations of child abuse by the journalist. In the article, the author had given the reference of a video shared by Taneja on his social media channels which showed his elder daughter having her ears pierced.

To this, the Delhi High Court observed, “Piercing the ears of a girl child cannot be termed as child abuse. Allegations of child abuse are serious allegations and cannot be made without due care and verification. It cannot be based on the opinions of the author.”

“Vicious attacks cannot be made”: Court on Journalists
The court also noted that while a person has rights to criticize the views of an individual, it also noted that “vicious attacks cannot be made on the character of a person under the guise of journalistic freedom”. “There is nothing in the aforesaid videos to substantiate allegations of child abuse,” the court added.
Ultimately, the court directed the newspaper to take down the article, and the defamatory tweets against Taneja and Rathee.
