Kerala HC Reunites Lesbian Couple After One Partner was Abducted by her Own Family

In a landmark decision, the Kerala HC on Tuesday reunited the lesbian couple after one partner was abducted by her own family. The couple – Adhila Nassrin and Fathima Noora were forcibly separated by their families, with one partner being abducted by her family and forced into conversion therapy.

Earlier on Tuesday, the Kerala High Court’s 2-judge bench of Justices K. Vinod Chandran and C. Jayachandran let the couple approach them directly and spoke about the matter. When asked if they wanted to live together on their own accord, the two partners replied in affirmative.

An IndiaTimes report quoted Nassrin saying, “We are a lesbian couple and we became committed during school days. Our parents caught our relationship but we lied and still continued our relationship. After completing our degrees and getting a job, we left our homes and things started to fall upside down.” She further said that her parents initially took responsibility of them, however they were “playing” them and eventually mentally tortured them.

According to a TNM report, Adhila’s friend Dhanya was a witness of the couple being forcibly separated by their families. She further said that her family was afraid that Fathima Noora will be subject of physical and sexual abuse at the hands of her partner.

Noora’s aunt further said that Noora’s interest in women will change “once she senses the pleasures from a male”, the TNM report stated.

The Facts of the Matter

In a landmark win for LGBTQ+ community in India, the Kerala HC on Tuesday reunited lesbian couple Fathima Noora and Adhila Nassrin amid the polarizing stand on their relationship by the netizens and general public. For the unversed, Fathima and Adhila were ostracized by their families, with Noora’s family abducting her and forcing her into conversion therapy.

How the Court Came to Know About the Matter

The incident was brought to the court’s notice after a Habeas corpus was reported by Adhila. Following this, Fathima was brought before the court by the Binanipuram. In a relatively short proceedings, the 2-judge bench heard the matter and asked the couple directly if they want to stay together on their own will. The couple replied in affirmative and the couple passed an order in their favour.

Couple Faced Death Threats Due to Relationship

According to a Republic TV report, the couple wereostracized by their families and faced death threats after wanting to live together. Reportedly, the couple had eloped from their respective homes and had sought shelter at Vanaja Collective, a Kozhikode based NGO working for LGBTQ+ rights.

As the couple eloped, Fathima’s mother filed an abduction complaint against her girlfriend. “We are a lesbian couple and we became committed during school days. My parents took responsibility for us, but they were playing us. They have mentally tortured us,” Adhila said, in an exclusive Republic TV report.

Couple had Taken Refuge at NGO

Reportedly, after the couple took refuge at the NGO, Noora’s family filed a complaint at the police station. The police, on realizing that the women were adults, refused to take actions on the family’s false abduction complaint. The couple chose to leave the NGO and moved into Adhila’s relative’s house.

How Fathima Noora was Abducted by her Family

Later, Noora’s family forcibly took away. Noora’s family physically restrained her and dragged her away. When Adhila came to know about the same, she called the police. The family had by then taken Noora away.

Being Forced into ‘Conversion Therapy’

Based on the actions of the family, Adhila tried filing a complaint against her girlfriend’s family. However, the police refused to intervene, citing that it was a family matter. Earlier on April 29, Adhila somehow was able to speak Noora on the phone where Noora claimed that she was being forced to go into conversion therapy.

For the unversed, a conversion therapy is a widely confirmed unscientific process of “transforming” a person’s sexual orientation.
